The Florida Legislature missed an opportunity to protect Florida women against the newest form of domestic violence and take a position at the forefront of the battle against Internet crimes.
The legislative session ended on Friday, May 3rd, 2013 at 7:16 p.m. and the legislation to make Revenge Porn a felony level crime in Florida died an untimely death. The “Computer or Electronic Device Harassment Act” would have made it a felony to post nude images online and tag those images with personal identifiers without proper consent.
While it was a good sign the Florida legislature was willing to take up the issue, the law did have problems. At present, a victim of Revenge Porn has little recourse.
Florida law enforcement agencies are reluctant to initiate investigations into these offenses. Victims are frequently told there is nothing law enforcement can do because no crime has been committed, although victims feel as if there has been.
This predicament leaves victims only one alternative, to seek justice in the civil system.
Like the criminal justice system, the civil system does not have specific laws or statutes directed at Revenge Porn and victims must sue under privacy statutes.
