I say it all the time, “Depositions win cases!” I also get a lot of grief from opposing attorneys who do not like to do depositions, especially in domestic violence cases. Here is another example of how a deposition can win a case for clients.
Recently, I did a deposition of an investigator in a domestic violence case. The opposing party was sure the investigator was going to testify favorably for their side. It turns out just the opposite was true.
When I received the deposition transcript and filed it with the court, the opposing party dismissal all their claims on the eve of trial. A win for a client and a client how saw justice smile at him.
Depositions can cut a case short and save clients a lot of money as compared to going to trial. Depositions eliminate surprise testimony and witnesses who change their story on the fly.
