I get a lot of calls from clients who have been screwed by someone and want to sue. Often, the amount they are out is so small it doesn’t make sense to hire a lawyer to bring the case. Lawyers can run anywhere from $100.00 per hour to several hundred dollars per hour. Many times, a lawyer will require a retainer or amount to be paid upfront to start on the case. Sometimes, it just is not worth it to hire a lawyer. In the end, you may collect a few dollars, but you could be out much more in attorney’s fees.
Many clients want to sue for the principal of suing someone that did them wrong. This too can be an expensive proposition. When you are getting those monthly attorney bills, suing on principle becomes very expensive.
So what can you do? Florida has a small claims process that is geared toward persons bringing cases before the court without representation. This makes sense if you want to sue for a small amount. You can always have an attorney represent you if you choose to but most people go it on their own.
You can go to any courthouse in Florida and get all the forms to file a small claims case. They are fill in the blank forms and fairly easy to complete. You can fill them out right there and the clerk will file your case for you when you complete the forms.
